Founders
The UAE result is the easy half. An individual who buys, holds and sells crypto with personal funds pays no UAE income tax and no UAE capital gains tax. The harder half is the country you are leaving, which may tax gains made before departure, apply an exit charge or keep you resident for years.
We work through four questions in order:
Family offices
The vehicle decides the rate. Families holding digital assets usually combine two layers: a foundation that owns the wealth and a family office that runs it.
Family foundations. A foundation set up to preserve and administer family wealth, for identified beneficiaries and without carrying on a business, can apply under Article 17 of the Corporate Tax Law to be treated as tax transparent. Income is then looked through to the family members, who as individuals pay no UAE personal income tax. Our UAE crypto family office and wealth structuring practice sets these up. The Federal Tax Authority's family foundations guide updated in June 2026 extends this to wholly owned subsidiaries and to holding companies owned jointly by several qualifying foundations.
Family offices. A single family office is a service company and is generally taxed at 9%. In DIFC or ADGM it can reach 0% as a Qualifying Free Zone Person on qualifying income, such as holding shares for investment or treasury services to related parties, provided non-qualifying revenue stays below the lower of 5% of revenue or AED 5 million. DIFC applies a USD 50 million family net asset threshold for single family offices; ADGM applies USD 10 million. Families pooling outside capital use crypto fund formation.

| Single family office in DIFC or ADGM | 0% on qualifying income; 9% on the rest | Running investments, treasury and reporting for one family | De minimis test; substance; regulated activities need a licence |
| Mainland holding or operating company | 0% up to AED 375,000; 9% above | Operating businesses and Web3 companies | Licensing perimeter for client-facing activity |

Crypto income
The UAE taxes the person and the activity, not the token. The same staking reward is untaxed in a founder's personal wallet and taxable in a company that runs validators for clients.
Where the business serves clients worldwide, we structure the operating entity in a zero-tax jurisdiction, with a UAE company for the team, development and services, and with real substance at each level so the structure holds up under the UAE general anti-abuse rule and the rules where clients and founders sit. Tax optimisation
Every structure we build has to pass two tests: Article 50 of the Corporate Tax Law, the general anti-abuse rule, and the rules of every other country the family is connected to. Inside those limits, these are the levers that move the result.
A defensible UAE tax residence, documented with a Tax Residency Certificate and the evidence file behind it.
Personal holdings, foundation, free zone company or fund, chosen asset by asset rather than one structure for everything.
Free zone income sorted into qualifying and non-qualifying before year end, with the de minimis test tracked.
Office, staff and decision making in the UAE, so the structure stands up to the Federal Tax Authority and foreign tax offices. Start with UAE Web3 company formation.
Founder contributions and related party pricing documented at arm's length, as the family foundations guide requires.
A Tax Residency Certificate opens the UAE's double tax treaty network for dividends, interest and capital gains abroad.
Exempt crypto supplies limit input VAT recovery; returns filed on the old basis may need a voluntary disclosure.
Eligible resident businesses with revenue of AED 3 million or less can elect it for periods ending on or before 31 December 2029.
CARF reporting
The UAE signed the CARF multilateral agreement in September 2025, and the Ministry of Finance issued a readiness circular in October 2026. Crypto-asset service providers in the UAE will collect tax residency self-certifications and report transactions of users resident in other participating jurisdictions. CRS 2.0 applies from the same date.
For holders and families: expect your exchange or custodian to ask where you are tax resident. If you are resident elsewhere, that country will receive your data. A UAE Tax Residency Certificate and a consistent self-certification matter more than ever.
For platforms: the work is classification, onboarding changes, data mapping and an XML reporting build, alongside the licence itself: crypto exchange licence, crypto custody licence or broker-dealer licence. Registration deadlines and technical detail are still to come in later Ministry guidance.

Not in the UAE, if you are investing your own funds. There is no personal income tax and no capital gains tax for individuals. Your home country may still tax you, depending on its residence and exit rules.
Only if the trading amounts to a business activity and your turnover from UAE business activity exceeds AED 1 million in a calendar year. Personal investment that does not need a licence stays outside corporate tax.

Generally at 9% on profit above AED 375,000. A family office in DIFC or ADGM can pay 0% on qualifying income as a Qualifying Free Zone Person, provided non-qualifying revenue stays below the lower of 5% of revenue or AED 5 million.

Not automatically. Many countries apply exit taxes, deemed disposal rules or extended residence periods. We map your departure position with your home country adviser before you move assets or file a final return.
It can. A UAE resident company or individual with revenue of AED 3 million or less in the current and all previous tax periods can elect the relief for periods ending on or before 31 December 2029. Qualifying Free Zone Persons cannot.
